Effective date: January 1, 2025. These Terms & Conditions (“Terms”) govern your use of the adcreafy.ai platform and services. By creating an account or using the service, you agree to these Terms. Please read them carefully.
Account Creation: You must create an account and provide accurate, current, and complete information. You agree to keep your account credentials (username/password) secure and confidential. You are responsible for all activity under your account.
Eligibility: You represent that you have the legal authority to enter into this agreement (you are of legal age or have parental consent where required). If you are using adcreafy.ai on behalf of a company, you represent that you have the authority to bind that company to these Terms.
Account Suspension: We may suspend or terminate your account if you breach these Terms or violate our policies, or if we suspect fraudulent or illegal activity.
Permitted Use: adcreafy.ai provides AI marketing tools and analytics. You may use the service only for lawful purposes and in accordance with these Terms.
Prohibited Conduct: You must not misuse our services. Prohibited actions include: using the service for illegal activities; violating intellectual property or privacy rights; sending spam or malware; interfering with the service (e.g. testing security without permission); or reselling the service except as authorized by us.
Third-Party Features: Our service may integrate with third-party platforms (e.g. social media or advertising networks). Your use of those features may be subject to additional terms set by those third parties. You agree not to circumvent or violate those third-party terms.
Fees: Some features of adcreafy.ai may require payment (subscriptions, add-on services). You agree to pay all fees for such services, using the payment method you provide. All prices are in USD and exclude applicable taxes.
Billing: Payments are processed by third-party payment processors. We do not store your full payment card details. You authorize us (and payment processors) to charge your card for all approved charges.
Refunds and Cancellations: Unless otherwise stated, all fees are non-refundable. You may cancel your paid subscription at any time; cancellation will be effective at the end of the current billing period. We reserve the right to change prices with notice, and to terminate free trials or promotional offers.
Your Content: You retain all rights to any content you upload or create using the service (e.g. text, images, data). You grant adcreafy.ai a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content as needed to provide the service.
User Obligations: You are solely responsible for your content. You agree not to upload or publish content that is illegal, infringing, obscene, defamatory, or harmful. You must have the rights to any content you share. We have no obligation to monitor your content, but we reserve the right to remove or disable any content that violates these Terms or is objectionable.
DMCA Notice: We respect intellectual property rights. If you believe someone is infringing your copyright on our platform, please submit a proper DMCA takedown notice. We will remove or disable access to allegedly infringing content in accordance with the DMCA safe harbor provisions.
Our IP: The adcreafy.ai platform and all related technology (software, algorithms, designs, etc.) are owned by us. All rights not expressly granted to you are reserved. You may not copy, modify, distribute, or reverse engineer our service.
Feedback: If you provide feedback or suggestions, you assign any rights in that feedback to us, and we may use it without restriction.
Either you or we may terminate these Terms at any time. If you choose to terminate, you can do so by deleting your account. We may terminate or suspend your access for any reason, including breach of these Terms. Upon termination, your right to use the service ends, but we may retain and use your data as described in our Privacy Policy.
No Warranty: The service is provided “as is” and “as available,” without warranties of any kind. We do not guarantee the service will be uninterrupted, error-free, secure, or meet your expectations. We expressly disclaim all warranties, whether express or implied (including merchantability or fitness for a particular purpose. You Assume Risk: You are responsible for any decisions or actions based on using our service. We do not guarantee the accuracy or effectiveness of any marketing results.
To the maximum extent permitted by law, adcreafy.ai (and its owners, employees, affiliates) will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, business interruption, or data loss. Our total liability for any claim arising from these Terms or the service will not exceed the amount you paid to us in the 12 months before the claim, or $100, whichever is greater.
You agree to defend, indemnify, and hold adcreafy.ai harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the service, your violation of these Terms, or your infringement of any third-party rights.
These Terms are governed by the laws of the State of California (without regard to conflict of law principles). Any legal suit or proceeding arising out of these Terms will be brought exclusively in federal or state courts in California. If any provision is held unenforceable, the rest of the agreement remains in effect.
We may modify these Terms at any time. We will post updated Terms on our site and update the “Effective Date” above. If you disagree with a material change, you should stop using the service. Your continued use after changes indicates your acceptance of the new Terms.
Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and adcreafy.ai regarding the service.
Waiver: Failure to enforce any right does not waive that right.
Assignment: You may not transfer your rights or obligations under these Terms without our consent.
